The Provisions on the Review of the Establishment of Designated Pig Slaughtering Plants (farms) have been reviewed and adopted at the 11th Executive Meeting of the Ministry of Agriculture and Rural Affairs on November 25, 2024, and are hereby promulgated and shall come into force as of March 1, 2025.
Set up inspection regulations for designated pig slaughterhouses (farms)
Article 1 These Provisions are formulated in accordance with the Animal Husbandry Law of the People's Republic of China, the Animal Epidemic Prevention Law of the People's Republic of China, the Regulations on the Administration of Pig Slaughter and other laws and administrative regulations in order to standardize the establishment and review of designated pig slaughtering plants (farms) and strengthen the administration of pig Slaughter.
Article 2 These Provisions shall apply to the application, acceptance, examination, decision and supervision of the establishment of designated pig slaughtering plants (farms).
Article 3 The review of the establishment of designated pig slaughterhouses (farms) shall follow the principles of law, openness, fairness, justice and convenience to the people.
Article 4 The Ministry of Agriculture and Rural Affairs shall be responsible for supervising and guiding the establishment and review of designated pig slaughterhouses (farms) throughout the country.
The competent departments of agriculture and rural affairs of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for supervising and guiding the establishment and review of designated pig slaughtering plants (farms) within their respective administrative areas.
Under the leadership of the people's government at the same level, the competent department of agriculture and rural affairs of the municipal people's government divided into districts shall be responsible for the specific work of the establishment and review of designated pig slaughterhouses (farms) within their respective administrative areas.
Article 5 An application for the establishment of a designated pig slaughtering plant (farm) shall comply with the national industrial policy and the development plan of the pig slaughtering industry approved by the people's government of the province, autonomous region and municipality directly under the Central Government, and meet the conditions stipulated in Article 67 of the Animal Husbandry Law of the People's Republic of China and Article 11 of the Regulations on the Administration of Pig Slaughtering.
Article 6 Before the construction of a designated pig slaughterhouse (farm) project, the applicant shall submit the site selection needs to the competent department of agriculture and rural affairs of the people's government at the county level in accordance with the provisions of the Measures for the Review of Animal Epidemic Prevention Conditions.
The competent department of agriculture and rural affairs of the people's government at the county level shall, before confirming the site selection, request in written form the competent department of agriculture and rural affairs of the people's government of the municipality divided into districts whether the project meets the requirements of the development plan of the pig slaughtering industry of the province, autonomous region or municipality directly under the Central Government. The competent department of agriculture and rural affairs of the people's government of a districted city shall consult the municipal people's government and solicit in writing the opinions of the competent department of agriculture and rural affairs of the people's government of a province, autonomous region or municipality directly under the Central Government, and promptly reply to the competent department of agriculture and rural affairs of the people's government at the county level.
Article 7 After completion of construction, the following materials shall be submitted for the application for the establishment of a designated pig slaughtering plant (plant) :
(1) Application form for review of the establishment of designated pig slaughtering plants (farms);
(2) The water quality inspection report of the production water, or the water supply contract signed with the centralized water supply unit for drinking water (water payment voucher), etc.;
(3) The general plan of the plant (field) area, the process plan and process description of the slaughter room and the emergency killing room;
(4) A list of facilities and equipment for slaughter, inspection, disinfection, pollution prevention and control and other means of delivery;
(5) the roster of slaughter technicians and health certificates;
(6) the roster of veterinary health inspection personnel, health certificates and examination certificates;
(7) A list of harmless treatment facilities and equipment, or a list of harmless treatment entrustment agreements and temporary storage facilities and equipment.
Animal epidemic prevention qualification certificate, sewage discharge permit or sewage discharge registration form, as well as possibly involved in the river discharge outlet setting consent documents and other relevant certification materials in line with environmental protection requirements, the examination and approval department through inquiries and other ways to verify the relevant information.
Article 8 The competent department of agriculture and rural affairs of the municipal people's government divided into districts shall, in conjunction with the competent department of ecological environment and other relevant departments, review the application for the establishment of a designated pig slaughtering plant (farm) in accordance with the development plan of the pig slaughtering industry.
The competent department of agriculture and rural affairs of the people's government of the city divided into districts shall conduct material audit and on-site verification in accordance with these provisions and the specific requirements of the quality management standards for pig slaughter formulated by the Ministry of Agriculture and Rural Affairs on plant, facility and equipment, process and personnel.
The people's government of a districted city shall, on the basis of the review and the opinions of the competent department of agriculture and rural affairs of the people's government of a province, autonomous region or municipality directly under the Central Government, decide whether to approve the establishment of a designated pig slaughtering plant (farm). If the establishment is approved, a certificate for the fixed-point slaughter of pigs and a sign plate for the fixed-point slaughter of pigs shall be issued; If the establishment is not approved, the applicant shall be informed in writing and the reasons shall be given.
Article 9 Where the name, legal representative (responsible person) or production address of the designated pig slaughtering plant (plant) is changed (the actual production address has not changed), it shall, within 15 working days after the market supervision and administration department handles the registration formalities for change, apply to the original certification authority for changing the certificate of designated pig slaughtering, and submit the following materials:
(1) Application form for change of information of designated pig slaughtering plant (farm);
(2) the original certificate of designated slaughter of live pigs before the change;
(3) A copy of the changed business license.
If the application materials submitted by the applicant are complete and meet the requirements, the original issuing authority shall issue a replacement certificate of designated slaughter of live pigs within five working days.
Article 10 Where a designated pig slaughtering plant (farm) is relocated to a new site or rebuilt at the original site, it shall apply for a new certificate of designated pig slaughtering.
Article 11 Designated pig slaughtering plants (farms) shall fill in the relevant information in the national livestock and poultry slaughtering industry management system in accordance with the requirements of the Ministry of Agriculture and Rural Affairs.
The competent agricultural and rural departments of the people's governments at or above the county level shall strengthen information review, data use and safety management.
Article 12 Where a designated pig slaughtering plant (farm) closes or ceases business, it shall submit a written report in advance to the competent department of agriculture and rural affairs of the local people's government at the county level. If it is difficult to report in advance due to objective reasons, the report shall not be made later than the day after business closure or suspension.
Article 13 Where a designated pig slaughtering plant (farm) closes down or ceases business for more than six months, it shall report to the competent department of agriculture and rural affairs of the people's government of the city divided into districts before resuming production. The competent department of agriculture and rural affairs of the municipal people's government divided into districts shall conduct supervision and inspection in a timely manner, and those who do not meet the prescribed conditions shall be dealt with in accordance with the provisions of Article 30 of the Regulations on the Administration of Pig Slaughter.
Article 14 Where the certificate of fixed-point slaughter of live pigs should be cancelled according to law, and where the fixed-point slaughtering plant (farm) of live pigs reports that it is no longer engaged in pig slaughtering activities, the original issuing authority shall go through the cancellation procedures, recover the certificate of fixed-point slaughter of live pigs and the sign plate of fixed-point slaughter of live pigs, and publish it to the public.
Article 15 The applicant shall truthfully submit the application materials, reflect the true situation, and be responsible for the authenticity of the application materials.
If the applicant conceals the relevant information or provides false materials, it shall not be accepted or denied the administrative license, and shall be given a warning, and the applicant shall not apply for the administrative license again within one year.
The applicant who obtains the certificate of designated slaughter of live pigs by cheating, bribery and other improper means shall be given administrative punishment according to law, and the applicant shall not apply for the administrative license again within three years.
Article 16 Where a designated pig slaughtering plant (farm) is relocated to a new building or rebuilt on the original site, it shall be punished in accordance with the provisions of Article 31, paragraph 1, of the Regulations on the Administration of Pig Slaughter.
Article 17 Provinces, autonomous regions and municipalities directly under the central government may refer to these Provisions for the establishment and review of other livestock and poultry slaughtering enterprises under designated slaughtering management.
Article 18 These provisions shall come into force as of March 1, 2025.
